Terms for families
1. What Vinga is
Vinga is an online platform run by If Not Why Not GmbH, Rosenthaler Str. 72A, 10119 Berlin, Germany ("Vinga", "we"). On Vinga, independent coaches offer in-person activities for kids, such as sports, music, art, cooking and tutoring.
Vinga does not run the activities. Each activity is offered, run and sold by its coach. When you book, your contract for the activity is with the coach, and the coach is responsible for the activity. Vinga provides the platform: the listing, booking, payment flow, reminders and messages.
Vinga is independent of schools. A community site such as community.joinvinga.com is for families of that school community, but the school does not organise, supervise, endorse or take responsibility for any activity on Vinga, and receives no data from Vinga.
2. Who can register
- A parent or legal guardian, for themselves and their kids under 18, or a participant aged 18 or over for themselves.
- You need the access code of your community site to register. Don't pass the code on outside the community. We change it from time to time; your existing account keeps working.
- Your details must be correct, and you keep your password private.
3. Booking and paying
- The activity page shows the coach, price, dates, place, age range, capacity and the coach's cancellation window.
- When you book, you pay the coach through Stripe. The payment goes directly to the coach's Stripe account. The coach is the seller, and receipts and invoices come from the coach. Families pay no Vinga fee.
- For each kid and booking, a parent confirms the participation consent shown at booking.
- Free trial: where the coach offers one, a kid can take one free trial per activity.
- Packs: a pack is a number of sessions of one activity at a discounted price. Pack sessions do not expire and can only be used for the activity they were bought for.
- If a coach stops an activity, unused pack sessions are a matter between you and the coach, who is the seller. The coach tells you how they handle them, for example a refund. Vinga is not responsible for them.
4. Cancelling and changes
- You cancel before the coach's cancellation window (24 or 48 hours before the session, shown on the activity page): you get your money back for a single session, or the session goes back into your pack.
- You cancel inside the window, or the kid doesn't come: the session is used and not refunded.
- Every coach on Vinga is a business, so consumer law applies to your booking.
- The coach cancels: full refund, or the session goes back into your pack.
- The coach moves a session: you choose whether to keep the new time or get your money back. If you don't reply within 48 hours, you are refunded automatically.
- Weather, holidays and other outside reasons: the coach decides and lets you know. It counts as a coach cancellation.
- Refunds are made by the coach through Stripe to your original payment method.
5. Right of withdrawal
Single sessions and trials on a specific date have no 14-day right of withdrawal, because they are services related to leisure activities with a fixed date (Art. 16(l) Directive 2011/83/EU; § 312g(2) no. 9 BGB; Art. 103(l) TRLGDCU). Your cancellation rights are the ones in section 4.
Packs: you can withdraw from a pack within 14 days of buying it, without giving a reason.
- If you have not used any session of the pack, you get the full price back.
- If you booked and used sessions within the 14 days, you asked the coach to start during the withdrawal period. If you then withdraw, you pay for the sessions used, pro rata to the pack price, and get the rest back.
- After 14 days, or once all sessions of the pack are used, you can no longer withdraw.
The easiest way: in My bookings, use Withdraw from contract here next to the pack and confirm. You get a confirmation with the date and time. You can also send a clear statement to the coach (their contact details are in your booking confirmation) or to hello@joinvinga.com, and we pass it on. You can use the model form below; you don't have to. The coach refunds you within 14 days through Stripe to your original payment method.
Model withdrawal form To {coach name, address, email}: I hereby withdraw from my contract for the following service: {pack, activity}. Bought on {date}. Name: … Address: … Date: … (Signature, only on paper)
6. Safety rules for every activity
These rules apply to every activity on Vinga:
- Emergencies: in an emergency the coach calls the emergency services (112), stays with the group and informs the parents straight away. The coach never leaves the group to go somewhere with one kid.
- Toilet: Kids go to the toilet before the session. The coach cannot leave the group to accompany a kid during the session.
- Arrival and leaving: organised by the coach and/or the parents. At booking you say whether the kid arrives and leaves alone or is dropped off and picked up. Outside the session time the coach is not responsible for the kid.
- Health: please tell the coach about allergies or health matters that are relevant to the activity, by adding them to the kid's profile.
- The coach may exclude a kid whose behaviour puts others at risk. The session the kid was excluded from counts as used and is not refunded; later bookings are not affected.
7. Messages
Vinga sends booking confirmations, reminders and changes by WhatsApp, and, where needed, by email. You can choose whether a kid's own WhatsApp number also gets reminders. Money matters always go to the parent.
8. Vinga's responsibility
- Vinga is responsible for running the platform with reasonable care. We check each coach's ID, the certificate required for work with minors, and liability insurance before they can offer activities, and again when documents expire.
- The coach is responsible for the activity itself, including safety, quality and keeping to the date.
- Vinga is liable without limit for intent and gross negligence and for injury to life, body or health. Otherwise Vinga is liable only for breach of essential obligations, limited to foreseeable, typical damage.
9. Reporting content and complaints
If you find content on Vinga that you think is illegal or breaks these terms, report it to hello@joinvinga.com with the link and a short explanation. We will review it and tell you what we decided. Complaints about an activity go to the coach first. If that doesn't resolve it, write to us.
10. Ending your account
You can delete your account at any time. We can suspend or close an account for serious or repeated breaches of these terms and will tell you why.
11. Changes to these terms
We tell you about changes at least 30 days in advance. If you don't agree, you can delete your account.
12. Law
Spanish law applies. You can bring a claim before the courts of the place where you live.
